These Terms & Conditions (“Terms”) govern your access to and use of AkiyaX (the “Service”), operated by Snack Software, LLC (“we”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. What AkiyaX is
AkiyaX is an informational platform that aggregates and translates publicly available property listings from third-party sources to help users discover second homes and vacation properties in Japan. AkiyaX is not a real-estate broker, agent, dealer, or party to any transaction, and does not provide legal, financial, tax, or investment advice.
2. No reliance; accuracy of information
Listing data, translations, currency conversions, hazard and terrain information, and other content are provided for general informational purposes only, on an “as is” basis, and may be incomplete, outdated, or inaccurate. You are solely responsible for independently verifying any information before relying on it or making any decision. We do not warrant the accuracy, completeness, or availability of any content.
3. Currency conversion
Prices shown in USD are approximate conversions from Japanese yen using third-party exchange rates and are provided for convenience only. The yen amount governs, and actual costs may differ. We are not responsible for conversion discrepancies.
4. Third-party listings & links
The Service references properties and links to third-party websites and sources that we do not own or control. We are not responsible for third-party content, listings, availability, or practices, and your dealings with any third party are solely between you and that third party.
5. Acceptable use
You agree not to misuse the Service, including by scraping or harvesting data, interfering with its operation, attempting unauthorized access, infringing others’ rights, or using it for any unlawful purpose. We may suspend or terminate access at any time, for any reason, without notice.
6. Intellectual property
The Service, including its design, text, software, and the AkiyaX name and branding, is owned by Snack Software, LLC and its licensors and is protected by applicable laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. All rights not expressly granted are reserved.
7. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SNACK SOFTWARE, LLC AND AKIYAX, AND THEIR OWNERS, AFFILIATES, AND PERSONNEL, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
9. Indemnification
You agree to indemnify and hold harmless Snack Software, LLC and AkiyaX from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service or your violation of these Terms.
10. Changes to the Service and Terms
We may modify or discontinue the Service, and update these Terms, at any time. Changes become effective when posted, and your continued use of the Service constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the United States and the state in which Snack Software, LLC is organized, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located there for any dispute.
